1. Agreement to Terms

By accessing or using PixyTrade ("Service"), operated by PixyTrade LLC ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

PixyTrade is a market analysis tool that provides real-time stock scanning, momentum detection, and order flow analysis. The Service is designed for informational and educational purposes only.

The Service does NOT:

  • Provide investment advice or recommendations
  • Execute trades on your behalf
  • Guarantee any trading results or profits
  • Constitute a solicitation to buy or sell securities

3. Subscription and Billing

Free Trial: New users may be eligible for a 5-day free trial. You will not be charged during the trial period.

Subscription: After the trial period, the Service is billed at $189 per month. Your subscription will automatically renew each month unless cancelled.

Cancellation: You may cancel your subscription at any time through your account settings or by contacting support@pixytrade.com. Cancellation takes effect at the end of your current billing period.

Refunds: We do not provide refunds for partial months of service. If you cancel, you will retain access until the end of your current billing period.

4. User Accounts

When you create an account, you must provide accurate and complete information. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use

We reserve the right to terminate accounts that violate these Terms or for any other reason at our sole discretion.

5. Acceptable Use

You agree NOT to:

  • Share your account credentials with others
  • Reverse engineer, decompile, or attempt to extract the source code of the Service
  • Use automated systems (bots, scrapers) to access the Service
  • Redistribute, resell, or commercially exploit the Service or its data
  • Use the Service for any illegal purpose
  • Interfere with or disrupt the Service's infrastructure

6. Intellectual Property

The Service, including its original content, features, and functionality, is owned by PixyTrade LLC and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or create derivative works based on the Service without our express written permission.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Service will be uninterrupted or error-free
  • The data provided will be accurate or reliable
  • Any trading strategies based on the Service will be profitable

8. Limitation of Liability

IN NO EVENT SHALL PIXYTRADE LLC, ITS DIRECTORS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your use or inability to use the Service
  • Any trading decisions made based on information from the Service
  • Unauthorized access to your account
  • Any interruption or cessation of the Service

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM.

9. Investment Risk Disclosure

IMPORTANT: Trading stocks and other securities involves substantial risk of loss and is not suitable for all investors. Past performance is not indicative of future results. You should:

  • Only trade with capital you can afford to lose
  • Consult with a qualified financial advisor before making investment decisions
  • Understand that all investments carry risk
  • Not rely solely on the Service for trading decisions

10. Indemnification

You agree to indemnify and hold harmless PixyTrade LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions.
